These Terms and Conditions (the “Terms”) govern your use of the Hotel Boreal website, including every page, form, email and text message program offered through it (together, the “Site”). “Hotel Boreal,” “we,” “us” and “our” mean Hotel Boreal of Two Harbors, Minnesota, which owns and operates the Site. “You” means anyone who visits or uses the Site.

By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Who may use the Site

You must be at least 18 years old to make a reservation, buy a gift card or submit content through the Site. The Site is not directed to children under 13, and we do not knowingly collect information from them.

2. Reservations and stays

Hotel Boreal opens in December 2026. Reservation requests sent through the Site are requests, not confirmed bookings, until we confirm them to you directly. Confirmed reservations are made and managed through Cloudbeds, our third-party reservation system.

Rates, availability, deposits, cancellation, check-in and check-out times, pet rules and other hotel policies are shown to you when you book and in your confirmation. Those booking terms apply to your stay and take priority over these Terms where the two differ. Room descriptions, photographs and amenities on the Site are for general information and may change.

3. Gift cards

Hotel Boreal gift cards may be purchased through the Site or at the property. Unless the terms shown at purchase say otherwise:

• Gift cards can be redeemed only for goods and services from Hotel Boreal, and only up to their remaining balance.
• Gift cards do not expire and carry no service or inactivity fees.
• Gift cards cannot be exchanged for cash or refunded, except where the law requires it.
• Treat a gift card like cash. We are not responsible for lost, stolen or damaged cards, or for use without your permission, but we will help where we reasonably can.
• Gift cards may not be resold, and cards obtained through fraud or unauthorized means may be cancelled.
• Gift card purchases are processed by third-party payment processors. We do not store full payment card numbers.

4. Special offers, packages and promotions

From time to time we may advertise packages, discounts, promotional codes, giveaways or other special offers. Each offer is subject to its own stated terms, including dates, availability and eligibility. Unless its terms say otherwise, an offer applies only to new reservations, cannot be combined with other offers, has no cash value, and may be changed or withdrawn at any time before you redeem it. Offers are void where prohibited.

Any giveaway, contest or sweepstakes will have its own official rules, which govern that promotion.

5. Email newsletter

If you sign up for our newsletter, we will send you news, offers and updates from Hotel Boreal. Every email includes an unsubscribe link, and you can opt out at any time.

6. Text message (SMS) program

If you opt in to receive text messages from Hotel Boreal, you agree to receive recurring automated promotional and informational text messages at the mobile number you provide. Consent is not a condition of any purchase or reservation.

• Message frequency varies. Message and data rates may apply.
• Reply STOP to cancel at any time. You will receive one message confirming that you have been unsubscribed.
• Reply HELP for help, or email hotel@thehotelboreal.com.
• Mobile carriers are not liable for delayed or undelivered messages.
• You confirm that you are the account holder for the mobile number you provide, or have the account holder’s permission to enroll it.

How we handle mobile numbers is described in our Privacy Policy. We do not sell or share mobile numbers or text-messaging consent with third parties for their own marketing.

7. Content you submit

The Site may let you upload photos, post reviews or comments, or send us other material (“User Content”). You keep ownership of your User Content. By submitting it, you give Hotel Boreal a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, display, edit (for example, to crop or shorten), and share it on the Site, on social media and in our marketing, with or without your name. Please do not submit anything you do not want shown publicly.

By submitting User Content, you confirm that you own it or have the right to share it, that anyone identifiable in it has agreed to its use, and that it is truthful where it describes your experience. You agree not to submit anything that:

• is unlawful, defamatory, harassing, hateful, obscene or threatening;
• infringes anyone’s copyright, trademark, privacy or publicity rights;
• contains personal information about someone else without their permission;
• is spam, advertising, or a review you were paid or offered something to write without saying so; or
• contains viruses or other harmful code.

We are not obliged to publish User Content, and we may review, edit, decline or remove any of it at any time. User Content reflects the views of the person who posted it, not Hotel Boreal.

8. Acceptable use

You agree not to use the Site for any unlawful purpose; to interfere with its operation, security or infrastructure; to submit false or someone else’s information in a form; to scrape or collect data from it by automated means; or to try to gain access to any part of it that is not offered to the public.

9. Intellectual property

The Site and its content — including text, photographs, graphics, logos, the Hotel Boreal name and branding, and the design of the Site — are owned by Hotel Boreal or its licensors, including photographers and other contributors, and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. Any other copying, distribution or use requires our written permission, or that of the owner concerned.

10. Third-party services and links

Reservations, payments, email, text messages, maps and other parts of the Site may be provided by third parties such as Cloudbeds, and the Site may link to other websites. Those services and sites are governed by their own terms and privacy policies. We do not control them and are not responsible for their content or practices.

11. Disclaimers

We work to keep the Site accurate and available, but it is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind about the Site, including that it will be uninterrupted, error-free or free of harmful components, or that information on it — including descriptions of the area, local businesses and events — is complete or current. Errors in rates or availability may be corrected even after a request has been sent.

12. Limitation of liability

To the fullest extent permitted by law, Hotel Boreal and its owners, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the Site. Our total liability for any claim relating to the Site will not exceed the greater of the amount you paid us through the Site in the twelve months before the claim, or $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnity

You agree to indemnify and hold harmless Hotel Boreal and its owners, managers, employees and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your User Content, your misuse of the Site, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Minnesota, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed. Changes apply from the date they are posted, and continuing to use the Site after that means you accept them.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. These Terms, together with our Privacy Policy and any booking or offer terms presented to you, are the entire agreement between you and Hotel Boreal about the Site.
